iPad vs. Galaxy Tablet: Apple Loses UK Appeal Over Samsung, How The Ruling Affects Both Companies

Apple lost their appeal against the July court decision which ruled that rival phone company Samsung didn't copy trade marketed designs from the iPad to use in the Samsung Galaxy tablet.

The decision ends the legal dispute in Europe but they're both fighting it out in places all around the world over other patents for tablets and smartphones alike according to Reuters.

"For the design of tablets in Europe this should be the final word," said Darren Smyth, a partner at a property law firm called EIP, to Reuters.

Britain's Court of Appeal upheld the country's High Court judgment even though there are some similarities between the Samsung's Galaxy and iPad.

They determined that the tablet does not infringe Apple's designs, even going as far to say that Samsung's products aren't even up to par compared to the iPad. The ruling affects all of Europe

Samsung continues to believe that iPad had no legit argument as they weren't the first to make the programs they're claiming Samsung stole from them.  

"We continue to believe that Apple was not the first to design a tablet with a rectangular shape and rounded corners," said a spokesperson from Samsung to Reuters.

Apple will now have to decide if they want to appeal the decision again this time to the Supreme Court. Even if they do, it's not guaranteed they'll see the case.

"I expect this will be the end of the line," said Smith. "An appeal to the Supreme Court is in principle possible but there has been no indication so far that Apple plans such an appeal."

Samsung has been showing commercials and releasing advertisements taking a shot at Apple for accusing them of stealing designs. If the case gets appealed again, they may continue to do so until a decision has firmly been reached.

Apple has yet to comment on the decision.
