The professional driver known for his breakthrough record in the 1960's, Norman Craig Breedlove, has filed a lawsuit against Museum of Science and Industry for a breach of contract, breach of fiduciary duty, gross negligence, and breach of implied covenant of good faith and fair dealing. The suit was filed in the U.S. District Court for the Northern District of Illinois last June 3.
The suit was filed due to alleged damage and negligence incurred by the very vehicle Breedlove drove to break world records for land speeds during his racing days. The vehicle involved is the "Spirit of America" which was under the care of the Museum of Science and Industry under loan by the said museum during the 1960's. According to Cook Country Record, a total of $400,000 of repairs and restoration is the estimated amount for the damages the vehicle sustained under the wing of the museum. The historical vehicle was put to display on the MSI as a loan for an exhibit, which Breedlove consented years ago.
An agreement between Breedlove and MSI was established and it was agreed that the car would be shown at the exhibit only, and if there are plans to have it shown anywhere else the MSI must have Breedlove's consent. If there are plans to stop showing the car to the public, it must be returned to Breedlove. October 2015 marks the end of the 50-year exhibit presenting the "Spirit of America". In a letter presented, the MSI indicated that the vehicle maintained its good condition and they offered to be an agent in selling the car or accept it as a donation for permanent possession. The 79-year-old Breedlove chose the latter, and he received the car on October 30.
Upon receiving the car, there was considerable damage seen, according to Auto Week. Graffiti marked the vehicle, and the aluminum frame was replaced and re-welded. According to the suit filed, the vehicle is in a state of irreparable damage. A minimum of $395,000 was asked on Breedlove's end for compensatory, consequential and incidental damages. Attorney's fees and costs are also demanded.
